Employing Non-UK citizens
It is a criminal offence for an employer to take on employees whose immigration status prevents them from working in the UK - the maximum penalties now include prison and an unlimited fine. Employers need to show that that have taken reasonable steps to establish eligibility to work in the UK.
You should ask potential employees to show the following documents - always make sure you see originals and keep a copy on file:
Either one of the following -
- A UK, EU (excluding Romania and Bulgaria), EEA (European Economic Area - the EU countries plus Iceland, Liechenstein and Norway) or Swiss passport
- A national identity card or UK residence permit stating that they are a national of the EU (except for Romania and Bulgaria), an EEA country or Switzerland
- A passport from another country with visas or endorsements which make clear that the person has the right to live in the UK or to stay without time limit
- A passport with a visa which states they have the right of UK residence as a family member of an EEA national living in the UK
- A passport which states that the person is a student or Working Holiday-maker with a current visa allowing them to undertake the relevant employment
- A Home Office Application Registration Card stating the new employee is an asylum seeker and is permitted to take employment
